1. Acceptance of Terms
By accessing or using this AMES Group website (“Site”) and the related services (“Services”), you accept to be governed by these terms of use (“Terms”). You cannot access or use the Site and/or Services if you don’t accept these Terms.
AMES Group (“AMES”, “we”, “our” or “us”) can change the Terms at any time. The fact that you continue to access/use the Site after any of the Terms have changed will signify your acceptance of the new/revised Terms.
2. About AMES Group
AMES Group is an education and immigration consultancy which was established in 2007. We assist students and professionals from countries such as the Philippines, Nepal, Egypt, Jordan, Vietnam and Indonesia, find and enrol in educational programs, and get student visas for Australia, New Zealand, United Kingdom, United States, Canada, Spain, Germany and France. Our services include:
- School/course selection and counselling – assisting you to choose the most suitable school/courses/pathways.
- School application assistance – helping you complete the application forms and deal directly with institutions.
- Visa application support – assisting you prepare and lodge student visas for multiple countries and other visa types in Australia using our registered migration agents.
- Other services – assisting you arrange airport pickup, referral to accommodation providers and providing you with post-arrival support.
This Site contains details of our services and enables you to inquire/book consultations and communicate with our offices.
3. Eligibility and user responsibilities
To use the Site and Services, you must be at least 18 years old or have the approval of a parent/guardian. You agree to use the Site in accordance with the law and comply with all relevant laws/regulations when using the Site.
When using the Site you must:
- Provide True Information – When you submit inquiries/forms you confirm that all of the information you supply is accurate, complete and up-to-date.
- Not Misuse the Site – You agree not to upload/transmit any malicious code, spam or illegal material, attempt to breach security to gain unauthorized access to the Site, or in any way disrupt the normal operation of the Site.
- Do Not Infringe Rights of Others – You agree not to post/upload/transmit any content that is libelous, indecent, threatening, harassing, an invasion of privacy or infringes any intellectual property/rights of others.
4. Intellectual property
All text, graphics, images, logos, trademarks and other materials contained in/on the Site are either owned by or licensed to AMES, except where otherwise stated. Provided you do not remove any copyright or proprietary notice, you may use, view, download and print information for your own personal and non-commercial use. No other use of the information (including but not limited to reproduction, modification, distribution or public display), is permissible without our prior written consent.
The AMES name/logo is a trademark of AMES Group. All other trademarks/trade names/service marks are the property of their respective owners. These Terms do not grant you any right or license to use any trademark, without the owner’s prior written consent.
5. Information only – no professional advice
Information displayed on the Site is for general information purposes only and while we try to keep the information current and correct, you should not rely on the information for legal, financial or immigration advice. 6. Third-party content and links
There might be third-party content on the Site and/or hyperlinks to third-party websites. Any link to an external website or embedded content from another provider is for your convenience only. AMES has no control over and does not endorse any third-party content or websites. Therefore, AMES accepts no responsibility for the content, privacy policies, or the functionality of the third-party content or websites. You access the third-party content at your own risk.
7. Limitation of liability
Subject to the fullest extent allowed by law, AMES, as well as its directors, employees, agents, and affiliates, shall not be liable for any kind of direct, indirect, incidental, consequential or special loss or damage resulting from your access to or use of the Site or Services. Such loss or damage may include loss of data, loss of profits or business interruption. Loss or damage can arise due to contract, tort (negligence included), statute, or any other form of liability.
However, nothing in this Agreement excludes, restricts or modifies any consumer warranty, right or remedy provided to you by the Australian Consumer Law or any other applicable legislation that cannot be excluded, restricted or modified by an Agreement. Nevertheless, to the greatest degree possible under the law, AMES will limit its liability for a breach of any non-exclusionary guarantee to either providing the Service again or to pay the price of the Service being provided again.
8. Indemnity
You agree to indemnify and keep harmless AMES and its officers, employees and agents from and against any claims, demands, actions, damages, losses, liabilities and expenditures (including reasonable attorneys’ fees) arising out of or related to:
- your access to or use of the Site or Services;
- your breach of this Agreement;
- inaccurate, misleading, or deceptive information you provide; or
- your violation of any rights of a third-party.
9. Termination
AMES reserves the right to, without prior warning, temporarily suspend or permanently terminate your access to the Site at any time for any reason it sees fit, including but not limited to if we reasonably believe that you have violated these Terms and Conditions or if we reasonably believe that you have conducted yourself in such a manner that could potentially damage our business or reputation. Upon termination, those provisions of this Agreement that by their very nature must continue to exist (such as the intellectual property rights of AMES, the disclaimer of warranties and limitation of liability) will remain in effect.
10. Privacy
Your privacy is of great importance to us. The collection, use and distribution of your personal information is subject to our Privacy Policy, which is a component of this Agreement. By accessing the Site, you hereby grant your approval to the collection and processing of your personal information in accordance with the Privacy Policy.
11. Changes to the Site and services
AMES can, at any time and without advance notice, alter, suspend or cease providing any portion of the Site or Services. AMES will not be liable to you or to any third party for any changes made to the Site or Services.
12. Governing law and jurisdiction
This Agreement is governed by the laws of the State of New South Wales, Australia. You hereby irrevocably submit to the sole jurisdiction of the Courts of New South Wales for the resolution of any disputes arising under or in connection with the Site or this Agreement.
